Le texte organise un contrôle juridictionnel expéditif, imposant au juge de statuer en deux jours sur une décision qui peut conduire à une mort provoquée.
Un tel délai ne permet ni l’examen du dossier médical, ni l’audition utile des parties, ni une décision véritablement motivée : ce n’est pas un contrôle juridictionnel, mais une formalité.
Cet amendement vise à mettre fin à cette précipitation dangereuse et à permettre au juge d’exercer réellement son rôle de protection.
